Acceptance of the general conditions of sale and conclusion of the contract:
The contract between “Azienda Agricola Imperiale Bolgheri” and the customer (i.e. the person who makes the purchase on the site, not related to his trade, business or profession) is concluded with the acceptance, even partial, of the order by “Azienda Agricola Imperiale Bolgheri”. In case of non-acceptance of the order, “Azienda Agricola Imperiale Bolgheri” will provide to give timely notice to the customer.
By placing an order in the various modes provided, according to the order form on the Site (hereinafter the “Order”), the customer claims to have read all the information provided to him during the purchase process and accept these general conditions (hereinafter the “Conditions”).
These Conditions may be printed or saved on a durable medium, in accordance with the provisions of art. 12 of Legislative Decree 70/2003 and art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.
Prices, purchase and payment methods
The prices indicated on the site are to be considered inclusive of taxes and VAT. Any shipping costs or payment costs are in any case communicated in advance to the Customer through the site or these Conditions.
The customer to place an order must fill in every part of the form during the purchase process on the site and send it after carefully reviewing the conditions and characteristics of the product and / or products you want to buy. The customer must also request “Azienda Agricola Imperiale Bolgheri” if you wish, the issuance of tax invoice for the purchase, pursuant to art. 22 D.p.R. n. 633/1972.

METHODS OF PAYMENT

In case of payment by bank transfer, the order will be processed upon receipt of payment.
The cash on delivery has an additional cost of € 10.00 when ordering. Payment will be made upon receipt of the goods. We recommend that you prepare the exact amount indicated in the e-mail notice of shipment because the courier can not give rest. If you will not be you to receive the goods remember to give instructions to one of your appointees and to leave him the necessary amount.
Delivery of products and related costs
The purchased products will be delivered to the address indicated in the Order by the Customer within 6 working days from the date of processing of the Order by “Azienda Agricola Imperiale Bolgheri”, at the cost indicated specifically in the Site before sending the Order. “Azienda Agricola Imperiale Bolgheri” reserves the right to accept or not deliveries required outside the Italian borders. In any case, for deliveries to be made outside the Italian borders, shipping costs and delivery times may vary.

Eventual inherent problems the physical integrity, the correspondence or the completeness of the received products must be signalled within 14 (fourteen) days from the happened delivery, second the modalities previewed in the present document.
Pursuant to art. 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may withdraw from the Conditions and therefore from the purchase contract for any reason, without the need to give reasons and without penalty, within 14 (fourteen) working days from the date of receipt of the products.
To exercise the right of withdrawal referred to in Article 5.1 above, the customer must send to “Azienda Agricola Imperiale Bolgheri” a notice to that effect, within the time specified, at the following email address firstname.lastname@example.org, or use the appropriate form on the site.
In case of withdrawal, the customer must return the products at our warehouse within 14 (fourteen) days from the withdrawal itself, contacting “Azienda Agricola Imperiale Bolgheri” at email@example.com.
The goods must be returned intact, complete with all its parts and in original packaging (envelopes and packages), kept and possibly used for the time strictly necessary to establish and verify the nature, characteristics and size, according to normal diligence, without any signs of wear or dirt, in compliance with the conditions below:
for the withdrawal to be possible, the product must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment;
In case a smell of cork is noticed in the “Imperfect” product of any vintage, the bottles must be closed again and sent back to the winery, which will then verify the problem, and once recognized, will send a new bottle of the same vintage totally at its own expenses.
-NB: The cost of shipping the product failed are charged to the user.
the shipment, until the certificate of receipt in the warehouse indicated by “Azienda Agricola Imperiale Bolgheri”, is under the complete responsibility of the customer;
in case of damage to the property during transport, “Azienda Agricola Imperiale Bolgheri” will notify the customer, to enable him to file a timely complaint against the carrier of his choice and obtain a refund, the product will then be made available to the customer, simultaneously canceling the request for withdrawal;
will not respond in any way for damage, theft, loss occurred during or in any way dependent on the shipment for the return.
“Azienda Agricola Imperiale Bolgheri” will refund the customer the full amount already paid net of any additional shipping costs pursuant to art. 56, paragraph 2, of D. lgs 21/14, within 14 (fourteen) days from the withdrawal, by transfer of the amount charged, using the same means of payment used by the customer for the initial transaction, unless otherwise agreed. In any case, the customer will not incur any cost as a result of this refund, except for the cost of return if it has not used the standard procedure indicated. “Azienda Agricola Imperiale Bolgheri” may suspend the refund until receipt of the returned product or until the time when the customer proves to have properly returned the product, if earlier.
In any case, the customer will forfeit the right of withdrawal in cases where “Azienda Agricola Imperiale Bolgheri” finds that:
the returned product and / or its accessories, and / or its packaging are not intact;
the product is missing its outer packaging and / or the original inner packaging;
the product is missing elements integral to the same and / or accessories.
In case of forfeiture of the right of withdrawal, “Azienda Agricola Imperiale Bolgheri” will return to sender the product purchased, charging the same shipping costs and, where already refunded, the price of the product.

The contract of sale referred to in these Terms and its execution and governed by Italian law, with the disapplication of the rules of conflict and the United Nations Convention for the International Sale of Goods. For the solution of the relative controversies it will be competent the Court of the town of residence of the Customer.
The contract replaces all previous contracts, agreements and understandings between the parties and constitutes the entire agreement between the parties regarding the object of the contract, together with the order, the general conditions relating to the use of the site.
Any variation or modification of the contract must be accepted in writing by both parties.
All communications between the parties must be made in writing and sent to the address of the other party indicated in the contract and in the order. Notices shall also be in writing if sent to the other party’s e-mail address as set forth on the Site and in your order.
Notices concerning the validity or existence of this agreement shall be delivered exclusively by hand or sent by registered mail with return receipt.
